In 2020, the Construction Industry Fatality Registry was created by New York State legislation. This law requires the New York State Department of Labor (NYS DOL) to maintain a public registry of workplace fatalities in the construction industry based on reports it receives from county coroners, medical examiners, and other authorized officials whose role is to register deaths. This guide includes important information for contractors facing a work-related fatal injury in their workplace.
 

What am I required to report?

When the NYS DOL notifies a contractor that a death in their workplace was reported by the county coroner, medical examiner, or other authorized official to be the result of a work-related fatal injury, the contractor is required to submit additional information regarding the workplace fatality to the NYS DOL.

When must I file a report with NYS DOL?

Additional information regarding the reported workplace fatality must be provided by the contractor to NYS DOL no later than 90 days after receiving the notification from NYS DOL.

What should be included in the report filed with NYS DOL?

Contractors notified of a work-related fatal injury in their workplace should include all of the following information in their reports:

  • Name of the contractor
  • Business address of the contractor
  • Stated business purpose or industry of the contractor
  • Name and age of the worker*
  • Ethnicity of the worker, if known
  • Nationality of the worker, if known
  • Immigration status of the worker, if known
  • Craft, trade, or occupation of the worker
  • Union status of the worker

*Under the law, “worker” includes, but is not limited to, direct employees, contracted employees, subcontracted employees, independent contractors, temporary or contingency workers, apprentices, interns, volunteers, or any other persons who perform duties at the direction and discretion of a contractor or who provide services pursuant to a contract in the workplace.

What happens if I fail to file a report within 90 days?

NYS DOL may impose a fine of $1,000 - $2,500 against contractors for failure to file a timely 90-day report.
