Overview
On March 23, 2003, the New York Professional Employer Act was signed into law. This act affected businesses by requiring professional employer organizations (PEOs) throughout New York State to adhere to requirements:
- Set forth by the State Legislature
- Enforced by the State Department of Labor
PEOs must either register or obtain an exemption. Each year they must renew their registration or exemption status. Other requirements include proof of:
- NYS Workers' Compensation and Disability Insurance
- Certification of the payment of taxes
- Content of contracts
- Identity of clients
