Overview
As of September 17, 2023, newly enacted Labor Law Section 194-B requires New York State businesses with four or more employees to provide job descriptions and list compensation ranges for designated job opportunities, promotions, and transfers. These ranges can consist of either the minimum and maximum annual salary or the hourly compensation believed to be accurate at the time of posting. Employers must also clearly state if a position is commission-based. Finally, this new law prohibits employers from retaliating against employees or applicants who request this information.
This law underscores New York's commitment to addressing wage disparities and promoting transparency in compensation practices across the state. It ensures that both employees and potential applicants have access to vital compensation information, and empowers them to make informed decisions about their careers.

File a Complaint
Any current, prospective, or potential employee or applicant who claims to have experienced a violation of this law can file a complaint with New York State Department of Labor. An organization acting on behalf of a current, prospective, or potential employee, or the recognized collective bargaining agent may also file a complaint.
Anyone who wishes to file a complaint or report a violation of New York State’s Pay Transparency Law should contact the New York State Department of Labor’s Division of Labor Standards. Any job, promotion or transfer opportunity that will be performed in New York City may also be covered by New York City’s Pay Transparency Law. Any complaint regarding a New York City based opportunity may still be addressed to the New York State Department of Labor.
