Responsibilities

  • Make recommendations to the Commissioner of Labor with respect to examinations, experience, and competence of such applicants.
  • Holds hearings prior to Commissioner's determination to suspend or revoke certificates, or to refuse renewal of certificates.
  • Reports findings and recommendations to the Commissioner with respect to such hearings.

Authority: 12 NYCRR 61

Membership Structure
Three members appointed by the Commissioner of Labor. At least one shall be a blaster who holds a valid certificate of competence and at least one other member shall be a representative of explosives manufacturers. Each member of the advisory board shall serve without salary or other compensation, but, shall be allowed necessary and actual transportation expenses incurred in the performance of his or her duties.

Elevator Safety and Standards Advisory Board

Responsibilities

  • Assist the Commissioner and the Department in establishing the state regulations for equipment covered by Article 33.
  • Develop recommendations for an enforcement program which will ensure compliance with the regulations and requirements promulgated by the Commissioner pursuant to Article 33.
  • Assist the Commissioner in granting exceptions and variances from the literal requirements of the applicable code and standards, regulations, and local legislation, in cases where such variances would not jeopardize the public safety and welfare.
  • Assist the Commissioner in setting fee schedules for licenses, permits, and inspections. The fees shall reflect the actual costs and expenses to conduct the duties as described in Article 33.
  • Assist the Commissioner in any and all things necessary or convenient to the Commissioner's duty to carry out the purposes of Article 33.

Membership Structure

Thirteen members: 7 members appointed by the Governor, 3 members appointed by the Temporary President of the Senate, and 3 members appointed by the Speaker of the Assembly. The appointees to the board shall be representatives of elevator manufacturers, building owners or managers, elevator industry construction workers, elevator servicing companies, elevator industry associations, elevator mechanics, or fire marshals. The board shall elect a chairperson to serve for the term of their appointment to the board. The members shall serve without salary or compensation, but, shall be reimbursed for necessary expenses incurred in the performance of their duties.

Membership Structure
The Commissioner shall appoint at least three examining boards. At least one member of such board shall be a certified Pyrotechnician and at least one other member of such board shall be a representative of a company that conducts pyrotechnics or fireworks shows. The members of the board and their representatives shall serve without salary or per diem allowance but shall be entitled to reimbursement for actual and necessary expenses incurred in the performance of their official duties pursuant to this section, provided however that such members and representatives are not, at the time such expenses are incurred, public employees or public officers otherwise entitled to such reimbursement.
