Workers' Compensation Law § 2(16)
Pursuant to Workers' Compensation Law § 2(16), the maximum weekly benefit that may be paid on or after July 1, 2010 and each July 1st thereafter is two-thirds of the New York State Average Weekly Wage (NYSAWW*).
The New York State Department of Labor's Research and Statistics Division has computed the New York State Average Weekly Wage (NYSAWW) for calendar year 2019 to be $1,450.17.
*NYSAWW is the average weekly wage paid in New York State during the previous calendar year as reported by the Commissioner of Labor to the Superintendent of Financial Services on March 31 of each year.
