Farm Laborers Wage Board Hearings

Overview

On Wednesday, December 15, 2021, New York State Labor Commissioner Roberta Reardon announced that she will reconvene a wage board to hold virtual public hearings to hear testimony to consider the existing overtime work threshold for farm laborers and the extent to which the overtime work threshold may be lowered in New York State.

Hearing details are listed in the table below. Speakers were scheduled on a first-come, first-served basis. Each speaker was allotted three minutes. Testimony was heard from farm laborers, agricultural employers, academic experts, and elected officials, among others. 

 

El miércoles 15 de diciembre de 2021, la Comisionada de Trabajo del Estado de Nueva York, Roberta Reardon, anunció que volverá a convocar una Comisión de Salario para llevar a cabo audiencias públicas virtuales para tomar testimonios con el fin de evaluar los límites actuales del trabajo de horas extras para trabajadores agrícolas y la posibilidad de que dichos límites de cobertura del pago por horas extras puedan ser reducidos en el estado de Nueva York.

Los detalles de la audiencia se describen en la siguiente tabla.  Los testigos fueron programados de acuerdo al orden en que se inscribieron.  A cada testigo se le asigno tres minutos.  Se escucharon testimonios de trabajadores agrícolas, empleadores agrícolas, expertos académicos y funcionarios electos, entre otros. 

 

Resolutions Adopted By the Farm Laborers Wage Board on 1/28/2022:

RESOLUTION 1. 
The overtime threshold for farm laborers, which is currently set at sixty hours, be reduced to forty hours.

RESOLUTION 2. 
The reduction of the overtime threshold from sixty to forty hours be phased in over ten years with reductions of four hours on a biannual basis.

RESOLUTION 3. 
The phase-in schedule will begin on January 1, 2024 with the threshold set at 56 hours; on January 1, 2026, with the threshold set at 52 hours; on January 1, 2028, with the threshold set at 48 hours; on January 1, 2030, with the threshold set at  44 hours; on January 1, 2032, with the threshold set at 40 hours.

RESOLUCIÓN 1.
El umbral de horas extras para los trabajadores agrícolas, que actualmente se establece en sesenta horas, se reducirá a cuarenta horas.

RESOLUCIÓN 2.
La reducción del umbral de horas extras de sesenta a cuarenta horas se introducirá gradualmente en diez años con reducciones de cuatro horas semestrales.

RESOLUCIÓN 3. 
El calendario de introducción gradual comenzará el 1 de enero de 2024 con el umbral establecido en 56 horas; el 1 de enero de 2026, con el umbral establecido en 52 horas; el 1 de enero de 2028, con el umbral establecido en 48 horas; el 1 de enero de 2030, con el umbral establecido en 44 horas; el 1 de enero de 2032, con el umbral establecido en 40 horas.

Background

On December 31, 2020, the Farm Laborers Wage Board filed a report and recommendations on the applicable overtime thresholds for farm laborers. Read the report and recommendations.

Under the Farm Laborers Fair Labor Practices Act, which was signed into law in 2019, farm laborers became entitled to overtime premium pay starting on January 1, 2020, for any work that they perform in excess of 60 hours per week, and for work performed on their designated day of rest.

As part of that act, the Commissioner of Labor was required to convene a farm laborers wage board to hold hearings and make recommendations as to overtime work and, specifically, the extent to which the overtime threshold for farm laborers can be lowered below 60 hours per week and whether any such reductions should be phased in through a series of successively lower thresholds.

Accordingly, the Commissioner of Labor convened a wage board with the following members:

  • David Fisher, President of the New York Farm Bureau
  • Denis Hughes, former President of the New York State AFL-CIO
  • Brenda McDuffie, President of the Buffalo Urban League.

Beginning February 28, 2020 five public meetings were held to hear testimony. The details of those meetings are in the table below.

Beginning November 19, 2020 additional meetings of the Board were scheduled to hear presentations from the Department of Labor, to discuss the written submissions and testimony received at the hearings, and to make recommendations on the overtime work threshold for farm laborers and the extent to which the threshold may be lowered. The meetings were open to members of the public and were conducted via videoconference. No public testimony was taken at these meetings. The details of these meetings are also in the table below.
