Under the Farm Laborers Fair Labor Practices Act of 2019, farm laborers became entitled to overtime premium pay starting on January 1, 2020, for any work that they perform in excess of 60 hours per week, and for work performed on their designated day of rest.

As required by the act, New York State Labor Commissioner Roberta Reardon convened a wage board comprised of the members listed below in 2020. Per the statute, the wage board was tasked with considering and making recommendations regarding the extent to which the overtime threshold for farm laborers can be lowered below 60 hours per week and whether any such reductions should be phased-in through a series of successively lower thresholds.

On February 22, 2023, The New York State Department of Labor announced that it adopted the final farm labor overtime regulations, codifying Commissioner Reardon’s order that adopted the Farm Laborers Wage Board’ report and recommendations in September 2022.

On February 22, 2023, the final farm labor overtime regulations were adopted, codifying Commissioner Reardon’s order adopting the recommendation of the Farm Laborers Wage Board to lower the current 60-hour threshold for overtime pay to 40 hours per week by January 1, 2032, allowing 10 years to phase in the new threshold.

Overtime

An employer shall pay an employee for overtime at a wage rate of one- and one-half times the employee’s regular rate of pay for hours worked in excess of the following number of hours in one workweek:

(a) 60 hours on or after January 1, 2020;
(b) 56 hours on or after January 1, 2024;
(c) 52 hours on or after January 1, 2026;
(d) 48 hours on or after January 1, 2028;
(e) 44 hours on or after January 1, 2030;
(f) 40 hours on or after January 1, 2032.

Un empleador deberá pagarle a un empleado por las horas extra a una tasa de salario de una vez y media la tasa de pago regular del empleado por las horas trabajadas en exceso de la siguiente cantidad de horas en una semana laboral:
